1. Introduction

Welcome to MBSHealth ("Service"), operated by MBS Health ("we", "us", or "our"). By accessing or using MBSHealth at app.mbs.health or our website at mbs.health, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Service.

2. Description of Service

MBSHealth is a software-as-a-service (SaaS) platform designed to help healthcare professionals, billing staff, and practice managers search, explore, and intelligently navigate the Medicare Benefits Schedule (MBS) book. The Service provides:

• A structured search and filtering engine for browsing 6,000+ MBS item numbers by category, group, and sub-group.
• An AI-powered rule validation engine that evaluates item claim submissions against a comprehensive database of rules extracted from the MBS book.
• MBSAssist, an intelligent AI agent that allows users to interact with the MBS book conversationally — asking questions in natural language and receiving source-backed answers drawn from the official MBS documentation.

MBSHealth is an independent tool and is not affiliated with, endorsed by, or connected to the Australian Government Department of Health and Aged Care.

3. AI-Generated Content and Validation Rules

The Service relies on artificial intelligence in two key areas: (a) the extraction and evaluation of validation rules from the MBS book, and (b) MBSAssist, which generates conversational responses based on the MBS documentation. While we are continuously working to review, verify, and improve the accuracy of all AI-generated content, you should be aware of the following:

• Validation rules and MBSAssist responses are generated using artificial intelligence and may contain inaccuracies, omissions, or errors.
• AI can make mistakes. All output provided by the Service — including validation results and MBSAssist responses — should be treated as guidance and not as a definitive or authoritative source.
• We are actively working towards extensively reviewing and approving all AI-extracted rules, however this is an ongoing process.
• You should always cross-reference any results, answers, or recommendations provided by the Service with the official MBS documentation and seek professional advice where necessary.

4. No Medical or Billing Advice

The Service does not provide medical, legal, financial, or professional billing advice. All information provided by MBSHealth — including search results, validation outcomes, and MBSAssist responses — is for informational and navigational purposes only. You should not rely solely on the Service for making billing or clinical decisions and should always consult qualified professionals and official MBS documentation.

5. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and up-to-date information during registration.
• Notifying us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms or are used in a manner we deem inappropriate.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to other users' accounts or to the Service's systems or networks.
• Use automated tools, bots, or scrapers to access the Service without our express written consent.
• Resell, redistribute, or sublicence access to the Service without our prior written consent.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the software, design, text, graphics, logos, the AI-extracted validation rules database, and the MBSAssist AI agent — are owned by MBS Health and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express permission.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in that policy. We are committed to protecting your personal data and handling it responsibly.

9. Subscription and Payments

Certain features of the Service may require a paid subscription. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase.
• Provide accurate billing information and keep it up to date.
• Accept that subscriptions may renew automatically unless cancelled before the renewal date.

We reserve the right to change pricing with reasonable notice. Refunds are handled on a case-by-case basis at our discretion.

10. Service Availability

We strive to maintain reliable access to the Service, but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage arising from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, MBS Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunities, arising from your use of or inability to use the Service.

Given that the validation rules and MBSAssist responses are AI-generated and may contain errors, we expressly disclaim liability for any decisions made or actions taken based on any output provided by the Service, including but not limited to validation results, search outputs, and MBSAssist responses.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the AI-extracted validation rules, MBSAssist responses, or any other AI-generated content are complete, accurate, or free from errors. All AI-generated output is provided as a supplementary navigation and verification tool and should not be used as a sole source of truth.

13. Indemnification

You agree to indemnify and hold harmless MBS Health and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service or your violation of these Terms.

14. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination will remain in effect.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
